These general terms and conditions of sale (GTC) apply to products sold by SASU LABORATOIRE USPALLA site - ZA DEKERGADIC - 22700 PERROS GUIREC, registered with the RCS DE ST BRIEUC UNDER NUMBER 751424987 via its website passionmarine.fr

These general conditions of sale may be modified at any time by SASU LABORATOIRE USPALLA; they will apply on the date of the order.

The customer declares that he has the capacity to enter into this contract, the general terms and conditions of sale of which are presented below, that is to say, to be of legal age and not to be under guardianship or curatorship. Consequently, if a person without legal capacity were to order
articles on the Site, their legal guardians (parents, guardians, in particular) would assume full responsibility for this Order and would have to honor the price.

SASU LABORATOIRE USPALLA

  • SASU LABORATOIRE USPALLA undertakes to honor orders received within the limits of available stocks.
  • SASU LABORATOIRE USPALLA reserves the right to suspend or close the account of a Customer who contravenes the provisions of these General Terms and Conditions.
  • SASU LABORATOIRE USPALLA reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully paid a previous order or with whom a dispute has not been resolved.

How do I order?

After selecting your products and completing your identification information, you will need to proceed to payment, which is made by bank card in secure payment of course!

You must complete all the mandatory fields specified on the electronic form, otherwise you will not be able to proceed any further.

You will be assigned an order number.
By clicking on the "Order" button at the end of your order, you accept the T&Cs without reservation.

The data recorded on the SASU LABORATOIRE USPALLA website constitutes proof of all transactions carried out with its customers.

Likewise, those recorded by the payment system constitute proof of financial transactions.

Delivery times

Ludivine and Céline prepare your orders as quickly as possible (2 to 3 working days) from Monday to Thursday noon (they are off on public holidays)

  • Home delivery by Colissimo: 2 to 3 working days.
  • Delivery to a relay point by Colissimo: 3 to 5 working days.

Order confirmation

After registering the order placed, the SASU LABORATOIRE USPALLA sends an order confirmation email to the customer. By keeping this email and/or printing it, the customer has proof of his order that SASU LABORATOIRE USPALLA recommends that he keep. Attention : This email confirms that the customer's order has been taken into account by SASU LABORATOIRE USPALLA and not that the ordered product is available. The order is taken into account and the delivery time begins to run, the working day following the date of the order. If the order is placed on Thursday at 12 noon, the time taken into account will be from Monday. If one of the items ordered is out of stock when we receive your order, we will allow ourselves:

  • Either to reimburse the customer for the missing product by check letter, or to contact the customer to agree on a delivery date for the entire order.
  • Or offer him a replacement product. In the event of delivery of a replacement product, the return costs resulting from the possible exercise of the customer's right of withdrawal will be borne by SASU LABORATOIRE USPALLA for this product only.

We can deliver our products to individuals in Europe. Delivery rates by country and by carrier. The contribution to shipping costs varies according to the amount of your order. Refund Policy

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay a penalty, but the return costs are your responsibility. In the event of exercising the right of withdrawal, the company SASU LABORATOIRE USPALLA will reimburse the sums paid, within 14 days following notification of your request and via the same means of payment as that used when ordering.

Conditions to be respected by the customer

Before returning the product to SASU LABORATOIRE USPALLA, the customer must contact SASU LABORATOIRE USPALLA by calling the above number in order to obtain a return authorization number to be clearly affixed to the product return package. Any product returned without a return number will be refused and returned to the sender. The risks associated with returning the product, whatever the cause, are the responsibility of the customer. If the product is lost by the carrier during this shipment, the customer is solely responsible and cannot be reimbursed by SASU LABORATOIRE USPALLA. Returns must be made in their original condition and unopened.

Price

The prices indicated are expressed in Euros including tax, excluding shipping costs.
All prices are given subject to obvious typographical error. If an error should occur, SASU LABORATOIRE USPALLA will contact the customer to inform them that the order will be invoiced under the corrected conditions.

Our products

The Uspalla laboratory mainly offers for sale ECOCERT/COSMOS certified cosmetic and hygiene products, manufactured in our own laboratory located in Perros-Guirec.

Payment conditions

the price of the products ordered is payable in full upon issuance of the order form by bank card of the following type: VISA or MASTERCARD or AMERICAN EXPRESS or PAYPAL or SHOPIFY PAY or APPLE PAY. The customer is required to provide: the type of payment card, the card number, the expiration date and the cryptogram. The customer guarantees that he/she is fully authorized to use said card and that it provides access to sufficient funds to cover all costs resulting from his/her order. The security of this payment method is ensured by: e-transaction by Shopify Pay.

Verification of delivered products

Upon receipt of the order, the customer is required to check the apparent condition of the products delivered (packaging and contents not damaged or damaged, particularly during transport) and the conformity of the quantity of product(s) delivered to the order. Any apparent defect and/or any non-conformity of the quantity of product(s) delivered to the order must be the subject of reservations by the customer to the carrier and must be confirmed by the customer, within three working days from the date of receipt of the product by the customer, by sending to SASU LABORATOIRE USPALLA: either a registered letter with acknowledgment of receipt, or an email. The customer must indicate on his request his customer number and the order reference.

Mediation

The customer is informed of the possibility of resorting to consumer mediation for disputes which may arise regarding the sale of Passion Marine products.

In accordance with the order of August 20, 2015 and the implementing decree of October 30, 2015, the customer may contact the CMAP – Centre de Médiation et d’Arbitrage de Paris – to settle amicably through mediation any dispute or litigation known as consumer dispute, subject to article L612-2 of the Consumer Code.

Disputes for which the request is manifestly unfounded or abusive, or has been previously examined or is currently being examined by another mediator or by a court, or if the customer submitted his request to the mediator more than one year after his written complaint to SASU LABORATOIRE USPALLA or if the dispute does not fall within the scope of the mediator's competence, or finally if the customer does not prove that he has previously attempted to resolve his dispute directly with SASU LABORATOIRE USPALLA by means of a written complaint, cannot be reviewed by the mediator.

Failing this, the packaging and products delivered will be deemed to be free of any apparent defect(s) and the quantity of products delivered to be in accordance with the order. No product may be exchanged before it has been reshipped and received by SASU LABORATOIRE USPALLA in good condition. Before returning the product to SASU LABORATOIRE USPALLA, the customer must contact SASU LABORATOIRE USPALLA by calling the above-mentioned number in order to obtain a return authorization number to be clearly affixed to the product return package. Any product reshipped without a return number will be refused and returned to the sender.

RESERVATION OF PROPERTY

THE PRODUCTS DELIVERED BY SASU LABORATOIRE USPALLA ARE SOLD WITH A CLAUSE EXPRESSLY SUBORDINATING THE TRANSFER OF THEIR OWNERSHIP UPON FULL PAYMENT OF THE PRINCIPAL AND ACCESSORY PRICE.

The simple delivery of a title creating an obligation to pay, draft or other, does not constitute a payment, the original debt of SASU LABORATOIRE USPALLA on the buyer subsisting with the guarantees attached thereto, including the retention of title , until the payment document or commercial instrument has actually been paid and the sums due collected by SASU LABORATOIRE USPALLA

FORCE MAJEURE

In the event of a transport strike, as well as in the event of a strike within our establishments or at our suppliers, as well as in the event of riots, war, attack, lack of raw or energy materials , or for any other case of force majeure, SASU LABORATOIRE USPALLA may suspend its deliveries, and cancel all or part of the orders in progress, without the customer being able to claim any compensation.

APPLICABLE LAW – DISPUTES

SOLELY WILL BE COMPETENT, IN THE EVENT OF A DISPUTE OF ANY NATURE AND ANY DISPUTE RELATING TO THE FORMATION, EXECUTION OR TERMINATION OF ORDERS PLACED TO SASU LABORATOIRE USPALLA, THE COMMERCIAL TRIBUNAL OF ST BRIEUC

This clause applies even in the event of interim relief, incidental request or multiple defendants or warranty appeal and regardless of the method or terms of payment.
